After reading my movie review, even my dad asked me: "Since you have some opinions, why don't you make a big deal?" I couldn't help but want to say: movies and reality are really different. !
First of all, it is a cliché: there is no distinction between solicitors and so-called barristers, also known as litigators, and there is no such thing as "promoting from a lawyer to a barrister". To use an analogy, a solicitor is more like a "part-time job". As long as you work diligently and don't make big mistakes, work with your boss regularly to add labor, and then find a headhunting company to change jobs for you, you can skyrocket to a million-dollar annual salary. Being a barrister is more like starting a business, because you are basically responsible for your own profits and losses and there is no guarantee of success. Of course, if you succeed, you will be as famous as a star, but I also know several barristers who resolutely jumped into this arena and finally left the arena sadly. The pressure is really extraordinary.
Why is the path to becoming a barrister so difficult? First of all, when I graduated as a barrister's apprentice, I had no income in the first year (the minimum salary is $6,000 starting in 2019), and I don't expect to have a substantial income in the first few years after I get the license. Unless your dad is Li Gang or really a 1st Hon who graduated with distinction, you will not have a connection with a big client. Your classmates at the same time are just junior lawyers who cannot refer big cases to you. You have no resume and no connections. Earn a living by taking on cases that legal aid or the master's fingers pass to you. Even if your father is really Li Gang, it will be useless without real talent and learning. The only people who always hire barristers are rich people. When they really face important issues, they can't even bother to curry favor with you, Li Gang's son. Therefore, there are more than 11,000 solicitors with practicing certificates, but only 1,600 barristers. Only one in 10 lawyers chooses to be a barrister.
Furthermore, if we really want to "plead for the people", I think it is more of a matter for solicitors rather than barristers. The most direct reason is that barristers cannot accept clients directly. In the absence of a representative from the solicitor firm, the court cannot even meet with the client alone, so even in the venomous court, Huang Zihua must be accompanied by the master and the prince before he can meet the guests. Not being able to see customers directly means that it is difficult to see you for small daily problems or poor people. The pressure of just asking for help from the public in the spotlight is too much for me. I can't bear it. It is more suitable for me to become your friendly neighborhood. Moreover, barristers have stricter rules than solicitors. To run a side business, you need to apply to the Bar Association for approval. I’m not even sure they can open a special page like mine to provide free legal advice. Finally, the purpose of a barrister can be said to be "to win in a conflict", which is slightly different from my central idea of "resolving/avoiding conflicts", so it is probably impossible for me to choose the path of a barrister in this life.
If I really want to say that there is something I envy about barristers, I think it might be that they have more romantic anecdotes. Maybe it’s because working hours are free but stressful?
